Medical Condition Misdiagnosed? 3 Reasons That Can Result In Receiving Compensation

Law Blog

Something as simple as a diagnosis of a medical condition can have unintended consequences that lead to bodily harm. If you feel like you were misdiagnosed due to negligence on behalf of a doctor, then you could have a viable lawsuit on your hand to help receive compensation for your financial losses. Here is what you should know about these three types of errors when diagnosing a condition.

1. Missed Medical Diagnosis

If you went to the doctor and were told that you were perfectly healthy, and later found out that you had some sort of bad illness, this is considered a missed medical diagnosis. It can be very dangerous due to how disease can spread in the body and make your overall health much worse. Many diseases are also easier to treat when they are just starting out, and as you may assume, more difficult once they have spread.

One disease that can have a missed diagnosis is dementia. If it is caught during the early stages, the decline of your cognitive function can be slowed down. Your body will have missed out on crucial treatments that make living with the condition manageable.

2. Delayed Medical Diagnosis

Another potential situation is being given the correct diagnoses from a doctor, but there being a long delay that can cause harm to your body. This can happen if symptoms of a medical condition are treated rather than getting to the root of the problem at hand. It a doctor treats a symptom for several months, only to later realize that it was caused by another condition, this could be considered medical malpractice.

For example, many forms of cancer can require intervention early on in the process. If it is ignored for months, it can be much more difficult to properly manage the disease.

3. Failed Medical Diagnoses

It is also possible for you to have several medical conditions, but a doctor was only able to diagnose one condition, resulting in a failed medical diagnosis. You'll be treating one disease while the other causes damage to your body.

A good example of a failed medical diagnosis is having pneumonia that causes chest pains, which is actually caused by a heart attack. If the pneumonia is diagnosed and treated, you may be living with problems such as weak heart muscles that cannot pump enough blood through your body. If left untreated, it could lead to heart failure, all while you think you just have pneumonia.

About ten years ago now, I was accused of a crime that I didn't commit, and it was really heartbreaking. I started thinking about what to do, and a friend of mine suggested working with a great lawyer. It was incredible to see how much help the lawyer was, and within a few months, I was proven innocent.
