Do You Need An Attorney For Custody Of Your Kids?

Blog

You have children in your care, but the other parent or even grandparents — or the actual parent of the children if you are a grandparent or other caregiver — are interfering with what you consider to be your rights to the kids. You don't want to lose your kids, especially when they are close to you and consider you to be their primary parent. Do you need an attorney for custody of your kids? A family law attorney can assist you, whether you have concerns about becoming a legal guardian, you are the actual parent of your kids, or you have other issues relating to custody and child care.

You need child support

Are you already the legal guardian or custodial parent of the children in question, but you aren't receiving any child support? Are you the primary caregiver for your children and you want to establish official custody so you can receive child support? Are you separated from the other parent and child support has not been ordered yet? These are things your family law attorney can assist you with.

Keep in mind that you will have to be granted some type of legal custody in order to receive child support or have a child support order granted. If you do not have official custody, your family law attorney will help arrange this for you.

You want more custody

Is there a child custody arrangement already in place? If so, and you want to make any changes to have more or less custody, you have to talk to your family law attorney to have this happen. You will have to file a motion to change the custody order and will have to prove your case of why you should get more visitation with your children. Modification of custody orders often go hand-in-hand with a modification to change child support in addition as well.

You want sole custody

You want to have sole custody of your children because you fear they are not taken care of properly or you are worried about their welfare. However, it's hard to get this custody unless the other parent gives up their rights or you have primary custody already and the other parent does not have a problem with sole custody. Your family law attorney will help you determine if you are able to get a case started for sole custody for your children, and will help you learn what you need to do to make this happen as well.

Creating A Solid Defense

When it comes to fighting in court, it isn't always easy to stay strong, stable, and secure in your convictions. Fortunately, by working with a great lawyer, things become much easier. About ten years ago now, I was accused of a crime that I didn't commit, and it was really heartbreaking. I started thinking about what to do, and a friend of mine suggested working with a great lawyer. It was incredible to see how much help the lawyer was, and within a few months, I was proven innocent. This blog is here to help people who might be fighting legal battles of their own.
