Tired Of Telemarketer Abuse? 3 Things You Should Know

Your phone is bombarded with calls every day, and most of them are from scammers and telemarketers.  In fact, USA Today has reported that 129.5 million spam calls are made daily. This has been made possible by the use of robot dialers. However, if you've had enough of these calls, you may want to consider taking legal action. Below are three things you should know before you sue telemarketers for abuse.

1. It is illegal for telemarketers to continue calling you after you tell them to stop

Telemarketers may consistently call you even when they know you're on the do-not-call list. However, you should know that this is illegal, and you can take legal action. Therefore, if you've signed up for the National Do Not Call Registry and telemarketers still call you, hang up on these calls, and talk to a lawyer before you file a telemarketer abuse complaint with the FTC. 

2. Log telemarketer calls

Although some telemarketers try to hide their phone numbers, most of them don't. Regardless, you can still log telemarketer calls using android or iPhone apps or keep a notebook near your phone. When telemarketers call, remember to do the following:

  • Write down the caller information and the time and date of the call
  • Ask for the caller's name, reason for calling, and website
  • Inform the caller to include you in their do not call list

Keep in mind that telemarketers can still make one accidental call legally, even after you request them to stop calling. Therefore, your telemarketer abuse lawyer may not use it as evidence when you sue. 

3. Take the telemarketer to court

The Telephone Consumer Protection Act (TCPA) helps to prevent telemarketer abuse. Therefore, if telemarketers have breached TCPA regulations, your telemarketer abuse attorney may advise you to expose them to a lawsuit. Your attorney can consider taking a telemarketer to court if they make the following TCPA violations:

  • They call you frequently without your permission
  • They call before 8 a.m. or after 9 p.m. 
  • They fail to disclose to you that they're telemarketers
  • They constantly call you at work
  • They call you even after you ask them to stop calling
