Witness Statements

One of the best ways to determine fault is to have a statement from someone that witnessed the accident. As long as this person is a neutral party in the accident, a statement saying what the other driver did wrong can really help your case. Just know that a statement from a passenger in your vehicle may not be as credible.

Physical Evidence

There is a lot of physical evidence that can be documented at the scene of an accident. That is why it's important to take pictures of everything to help preserve the evidence. This includes photographs of skid marks in the road, where the vehicles ended up settling after the crash, parts of the vehicles that are damaged and on the ground, as well as any property damage in the area. All of this evidence combined can really tell the true story of what happened. 

Video Evidence

You may be surprised at how many cameras your accident, which can really help prove your case. Even if you do not see traffic cameras in the area, it is worth looking at what homes and businesses have cameras. Doorbell cameras have become quite prolific recently, and many of them record continuously. It may be worth reaching out to a homeowner with a doorbell camera to see if it captured the accident. You should also contact nearby businesses that may have security cameras that are pointing towards the road. 

Police Report

It's always a good idea to call the police to the scene of the accident and make a police report. This is because the police will talk to each driver to get a statement and be able to see the aftermath of the crash. It is more likely that the other driver will be truthful because they can be questioned by the police officer when giving a statement. If you allow the other driver to go to the police station later and make a statement, it may end up having details that do not match what really happened.
